Judge dismisses forcibly touching charge against Former New York Governor Andrew Cuomo
The latest criminal investigation into former New York Governor Andrew Cuomo has come to an end. The Albany county district attorney office found the accuser Brittany Commisso to be “cooperative and credible but after reviewing all the available evidence we have concluded we can not meet our burden at trial.”
Back in August of 2021 when Commisso executive assistant to the then Governor Cuomo publicly accused him of groping her in the Executive Mansion along with several other women that came forward in New York Attorney General’s investigation into the former Governor.
Andrew Cuomo was scheduled for his first court appearance today to face the charge of forcefully touching. Legal experts found it shocking that they completely dropped the case all together. While women’s activists groups fear that this could prevent other women from coming forward because they aren’t seeing justice.
The former governor kept his innocence insisting he never touched anyone inappropriately. The Former Governor stepped down from his post back in August saying at the time “The best thing I can do is step aside and let the government get back to work.”
The Albany District Attorney David Soares is the fourth prosecutor to not pursue charges against Cuomo.
The former Governor only appeared in Court virtually for a few seconds before Judge Holly Trexler dismissed the charge of forcibly touching. The Judge cited past court decisions that favored district attorney’s discretion.
After the court appearance the former Governors Attorney Rita Glavin said in remarks called Albany County’s Sheriff Craig Apple a “rogue sheriff” and saying “today the rule of law prevailed.”
After the court case was dropped the former Governor released a statement on Twitter saying in part “..do not confuse our respect for the justice system with acquiescence.”
Brittany Commisso’s lawyer said they were not going to stop here and would be taking civil action against former Governor Andrew Cuomo.
